Question

I'm currently representing a Buyer who just hired an home inspection company. I'm preparing our inspection response and not sure if I can send the inspection report to the listing agent. Could you please remind me what's the rule there if there is one?

Answer

Based on the language in Form 35, buyer is prohibited from delivering buyer's inspection report to seller without seller's prior permission. Broker should obtain seller's or listing broker's permission, in writing, prior to delivery of the report. If buyer is claiming the Additional Inspection period, buyer is required to deliver ONLY the portion of inspector's report where inspector recommends that the buyer obtain additional inspection(s). Broker should redact the report, as necessary, so that the only item of the report delivered to seller or listing broker, is the inspector's recommendation for additional inspection(s).
